Terms of sale

Online store Borealis.ee (hereinafter Online Store) owner OÜ Borealis Holding (register code 11100242), located in Valukoja 7/2, Tallinn 11415.

Validity of sales contract, commodity and price information

  • The Terms of Sale apply to the purchase of goods from the online store.
  • The prices of the products sold in the online store are indicated on the products. Fees for delivery of the goods will be added to the price.
  • The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee will be displayed to the buyer when placing the order.
  • Information about the goods is provided at the Online store immediately after the goods.

Ordering

  • Online store prices are in euros with VAT.
  • To order goods, add the desired products to the cart. To complete the order, fill in the required data fields and choose the appropriate delivery method. The amount of the fee will then be displayed, which can be paid via a bank link or other payment solutions.
  • To order products, click the “Add to Cart” button on the product, therefore adding the product to the shopping cart. The shopping cart displays selected products, their cost and loyalty discount. To add products to your shopping cart or make a purchase, follow the instructions for the shopping cart. Choose the appropriate shipping method and you will see the shipping cost of the shipment.
  • If you would like to make the purchase, press the button “Continue”. You can enter your details in the window that appears. Fields market with an asterisk are mandatory. If you want the delivery details to be different from the payer’s details, select the “Send to another address” box and fill in the required fields. The “Order Overview” window shows the details of the entire order content and cost, and if you are sure that you want to make the purchase, click the button “Submit Order”.
  • In case of campaigns, you can add a promotional coupon code to the corresponding box in the Online store. Promotional coupon code information is shared in campaign information channels.
  • There is no need to create a user account for purchasing goods. However, it allows you to buy more conveniently – in the future your contact information is already pre-recorded.
  • Creating a user account takes place during the initial purchase. You must include your contact information for registration.
  • The contract starts from the amount of the price receiving to the Online store account.
  • If the ordered goods cannot be delivered because of the shortage of the goods or any other reason, the buyer shall be notified as soon as possible and the paid money (including delivery costs) shall be returned immediately, but not later than within 14 days of receiving the notification.

Payment for the goods

  • You can pay for the goods via bank link or order confirmation by transfer. After placing your order, a confirmation of your order will be sent to the e-mail address you entered. The order confirmation is marked with the bank details of OÜ Borealis Holding, where you can make the payment. In the explanation field, enter your order code. We ask you to pay within 2 days, after which the order will be cancelled, and the purchase must be rescheduled to make the purchase. We send/give out the original invoice together with the goods.
  • Borealis Holding OÜ is the chief processor of personal data and transmits the personal data necessary for the execution of payments to the authorized payment institution Maksekeskus AS-le.

Order fulfilment and delivery

  • Goods are shipped to the following countries: Estonia, Latvia, Lithuania and Finland.
  • The cost of shipping the goods is paid by the user, according to the cost of transportation calculated by consignment and location.
  • The ordered products will be posted within 1 to 2 business days after receipt of the invoice to OÜ Borealis Holding current account.
  • Shipments inside Estonia generally reach the destination specified by the user within 2-7 business days from the starting of the sales contract. Delivery outside of Estonia takes place within 7 to 10 calendar days.
  • The buyer may choose to pick up the goods himself when buying from online store. The goods ordered from the online store can be obtained from the sales office of Borealis, which the buyer has chosen when ordering the goods.
  • If the buyer wishes to receive the ordered goods from the sales office of his/her choice, then the additional costs of the goods for the transportation will not be added to the price.
  • In case of exceptional cases we have the right to deliver the goods within 45 calendar days.

Shipping and shipment cost

For orders over 50€, transportation within Estonia is FREE (except for the courier to home). Available shipping options:

Right of withdrawal

  • After receiving the order, the buyer has the right to withdraw from the contract entered in the online store within 14 days. The right to withdraw does not apply if the buyer is a legal person.
  • In order to use the 14-day right to return the product, the ordered goods may not be used in any way than is necessary to ascertain the nature, characteristics and functioning of the goods as they are permitted to be tested in the physical store.
  • If the goods have been used for any purpose other than that necessary to ascertain the nature, characteristics and functioning of the goods or show signs of use or wear, the Online store shall be entitled to reduce the refundable amount according to the decrease in the value of the goods.
  • To return the goods, you must submit an application for the withdrawal of the goods, the form of which can be found here: withdrawal notice and send it to sales@borealis.ee no later than 14 after the receipt of the goods.
  • The cost of returning the goods is paid by the buyer (up to 10€, VÕS §194 lg 4), if the goods are not incorrect or defective.
  • The buyer must return the goods after the submission of the application within 14 days to provide proof that they have handed over the goods to the Delivery within the aforementioned period.
  • Upon receipt of the returned goods, the online store returns the buyer immediately, but not later than 14 days after the receipt of the withdrawal application, all payments received from the buyer under the contract.
  • The online store may refuse to make refunds as long as the subject matter of the contract has been recovered or until the buyer has provided proof that they have returned the item, whichever comes first.
  • If the buyer has chosen something different form the cheapest ordinary delivery offered by the online store, the online store does not have to return to the consumer a cost that exceeds the usual delivery method.
  • The online store has the right to withdraw from the sale and demand the goods back, if the price of the goods have been marked under the market price of the goods.

The right to file a complaint

  • The online store is responsible for the lack of conformity or defect of the goods sold to the buyer that existed at the moment of giving over of the item and which occurs within two years from delivery of the goods to the buyer. Within the first six months of delivery of the item to the buyer, it is assumed that the defect already existed at the time of giving over the goods. Rejecting the corresponding assumption is an obligation of the online store.
  • The buyer has the right to contact the online store by sending an e-mail to sales@borealis.ee or call: 521 6979 in case of a defects within two months.
  • The online store is not responsible for any defects that have occurred after the goods have been delivered to the buyer.
  • If the goods purchased from the online store have defects for which the online store is responsible, the online store shall repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store shall return to the purchaser any fees due under the sales contract.
  • The online store will respond to the Customer’s complaints in writing or in a format that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

  • The online store uses the personal data entered by the buyer (including name, phone number, address, e-mail address, bank details) only for processing the order and sending the goods to the buyer. The online store transmits personal information to transport companies to deliver the goods.
  • The online store will send newsletters and offers to the buyer’s e-mail address only if the buyer has expressed a wish with entering an e-mail address on the website and has announced his/her wish to receive direct mail notifications.
  • The buyer can at any time give up the offers and newsletter sent to the e-mail by informing us by e-mail or following the instructions in the e-mail containing the offers.

Solving arguments

  • If the buyer has complaints about the online store, they must be sent by e-mail to sales@borealis.ee or call  521 6979.
  • If the buyer and the online store are unable to settle the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. Procedural conditions can be consulted and the application field here. The Consumer Disputes Committee is competent to settle disputes arising from the agreement concluded between the buyer and the online store. Reviewing the Buyer’s complaint by the Commission is free of charge.
